These staggering numbers can lead insurance companies to treat you like a statistic instead of a person. They could even call a car collision an accident.
You may even be inclined to accept the first settlement you are offered by an insurance company. However, the first insurance settlement may not be the amount you are entitled to after a preventable car accident; adjusters will look for any reason to downplay or minimize your injuries.

$500,000 Arbitration Award in Hays County Car Wreck Case
An 84 year old turned left in front of our client on FM 150 in Hays County. Our client received a neck injury as well as aggravated a prior back injury. The other driver’s insurance carrier hired an aggressive defense firm to contest liability in the wreck and our client’s damage claims. A week before the case was to be tried, the defense requested the case go to arbitration. The arbitrator rejected the defense’s position and awarded our client $500,000.
In Our Clients’ Words
Len was referred to me by a friend. I didn’t know him at all before meeting him and was very apprehensive toward attorneys in general. Len immediately put me at rest. He is very compassionate, ethical and handles himself with the utmost of integrity. He worked very hard on my case and was clear and up front with me every step of the way. I would highly recommend him to anyone. He is an extraordinary attorney!!!

During a difficult time in our life my wife and I were very lucky to find Leonard Gabbay. Our first visit with Mr. Gabbay and his team surprised us right away. Mr. Gabbay was professional, to the point, extremely honest and on top of that he was very compassionate and truly cared about our situation. These are traits that most lawyers we have met just don’t have.
Mr. & Mrs. Persaud (Client)
Len Gabbay is an excellent, compassionate and HONEST attorney. I was in a car accident in another state and was being asked by the other party to settle. Our insurance agent suggested that I first talk to Mr. Gabbay. I’m so happy I did. From the start he was honest with me and said it would be a difficult case. I’m glad he didn’t sugar-coat anything and promise me the moon.
LK (Client)
Len did a great job helping me out when I got hit by a car riding my bicycle to work last year. After I got hit, I made a number of mistakes, like not taking down the driver’s insurance information and declining police assistance on the scene. Len worked with me to track down the driver, get a statement, and deal with the insurance company.
Daniel (Client)
Outstanding. Every step of the way in resolving an accident I had on my bicycle was explained and handled with the utmost care. More than just a client, Len and his team always treat me like a friend – and I really appreciate that.Everything was fair, efficient, and simple. I know that I will be back if the need ever arises again.

Highly recommended from a very happy client Len Gabbay is an excellent attorney. I was struck by an SUV while riding my motorcycle. I had a very long recovery. I have never had any experience with this kind of thing. I wasn’t even sure I whether I needed an attorney. We consulted Len just to see if there was anything we needed to know. He walked us through all of the possibilities. He explained everything in terms that I could understand.

Our Process For Preventable Car Accident Cases
To help your case best, we may use an expert car crash reconstructionist to understand exactly what happened at the scene of your accident.
Using state-of-the-art technology and engineering skills, our accident reconstruction team answers many questions to get a complete picture of your accident. This may include, but is not limited to:
- What do the skid marks indicate?
- What type of surface was involved?
- What were the weather and road conditions at the time of the accident?
- What did the police reports show?
- Was there drunk driving or any other distraction/impairment involved?
- What did the eyewitnesses report?
- What does the injured victim remember about the accident?
- What was on the 911 tape?
Our accident reconstructionist will examine the vehicles involved and will inspect the scene. We will find any public data available, such as the timing and phasing sheets for traffic lights. Sometimes small details make all the difference.
We also pour over any photographs that you or anyone else might have taken at the scene of the accident. This includes photos of your injuries related to the car crash. Bruising, contusions, and abrasions are very important to us in telling your story. To an insurance company, if they can’t see it, it doesn’t exist.
From there, we handle both the personal injury and, in some instances, the property damage aspects of your case. We work with Life Care Planners who know what you/your family member will need over their lifetime to address their care post-accident.
We will also pursue many sources of compensation available to you from your insurance policy and the policy of the driver responsible for injuring you. Personal injury protection (PIP), medical expenses, and lost wages could come back to you, along with extra costs discovered by pain and suffering investigation.
Types of Preventable Accidents
No two accidents are the same. Leonard B. Gabbay and his team have the knowledge to deal with any collision scenario.
Hit-And-Run Accidents
Drivers who leave the scene of an accident usually do so because they fear prosecution for something they did wrong. In a high percentage of hit and run accidents, the hit and run driver was driving drunk. Rather than stopping and taking responsibility for what they did, the hit and run driver leaves the accident scene without even stopping to find out if their victim is alive or dead.
In Texas, one reaction of jurors in hit and run car accident claims is to punish the hit and run driver by awarding punitive or exemplary damages to the victim. Punitive damages can be far in excess of the actual damages caused by the accident. By awarding punitive damages, the jury sends a message to the community and to the irresponsible driver that it will not tolerate hit and run drivers.
Head-On Collisions
A head-on collision usually means that one car is in the wrong lane or traveling the wrong way. Head-on collisions often result in catastrophic injuries or fatalities and tend to be complex crash scenes. For all these reasons, you need a veteran personal injury lawyer on your side to investigate the accident and fight the insurance companies for appropriate compensation. Our crash reconstruction specialists work hard to prove that our clients are in the appropriate lane and that the other driver entered our client’s lane by:
- Making an illegal or dangerous pass
- Driving drunk
- Falling asleep at the wheel
- Driving while texting or otherwise distracted
- Driving the wrong way down the road
- Running a traffic light or stop sign
- Swerving suddenly to avoid an animal or obstruction
Rear-End Collisions
Often caused by distracted drivers who are not paying attention to what lies in front of them, rear end collisions are capable of causing catastrophic injuries such as spinal cord injuries, lifelong herniation injuries in the spine, concussion injuries, and even death. If you or a loved one have been rear-ended and injured as a result, it is important to have an experienced attorney handling your case.
We believe that you are going through a difficult enough time as it is and should not be burdened with the legal aspects of your situation. You can rely on us to handle all of your legal issues and aggressively pursue the compensation you deserve. That will leave you free to use your time and energy on your physical and emotional recovery.
Rollover Accidents
Any time a vehicle rolls over, something has gone horribly wrong. Most rollover accidents can be traced back to a point at which someone violated a safety rule, needlessly endangering the general public. Rollover crashes often result in high energy injuries including head and brain injury, spinal cord injuries, and unfortunately, paralysis and death.
There are a number of factors that can play a role in causing rollover accidents, from basic driver negligence to defective tires to defectively designed and manufactured vehicles. Sport utility vehicles (SUVs) are particularly prone to roll over due to their high centers of gravity.
