Resolving Claims With Arbitration
Similar in some ways to mediation, arbitration is a form of alternative dispute resolution (ADR) that is utilized to resolve a range of personal injury cases. However, the two are not the same. At Leonard B. Gabbay, P.C. in Austin, Texas, we have handled numerous cases through arbitration and can assist you in understanding which form of ADR is best suited to your situation.
Arbitration is an out-of-court option for resolving your personal injury case. Instead of mutually agreeing upon a decision as in mediation, an arbitrator acts much as a judge would. He or she listens to both sides argue their case and present evidence. Then the arbitrator reviews the case and makes a decision. It also offers the benefits of being a more cost-effective and efficient method of seeking a resolution to your situation than taking the case to court.
The result is legally binding and final. This can be beneficial to some while others see it as a pitfall. However, this prevents the case for continuing over an extended period of time. Compliance with the outcome must be done immediately upon delivery of the result by the arbitrator.
Any of the personal injury claims we handle may be resolved through arbitration, including:
- Truck, motorcycle and car accidents
- Premises liability
- Dog bites
- Nursing home neglect
