Civil Damages in DWI Cases
Drunk drivers who injure or kill people are subject to both criminal and civil penalties. At Leonard B. Gabbay, P.C., in Austin, Texas, we work hand-in-hand with local district attorneys, and we work to obtain compensation for the victims of drunk driving accidents in civil court.
Criminal penalties in DWI cases include fines, jail time and suspension of driver’s licenses. The penalties increase with second, third, fourth or more offenses.
Drunk drivers are also liable in civil court for the damages they cause to the victims in drunk driving accidents. In Texas, those damages may include:
- Reasonable and necessary medical expenses, including the cost of future care
- Loss of earnings
- Loss of earning capacity
- Pain and suffering
- Physical impairment, also known as loss of enjoyment of life. For example, if you can no longer go running or workout because of your injury, you can seek compensation for your loss.
- Disfigurement, such as burns and scars
- Punitive or exemplary damages. These are damages that address the behavior of the drunk driver. By awarding punitive damages, the jury sends a message to community as well as to the drunk driver that it will not tolerate drunk drivers.
We will always seek the possible compensation for our clients. You will not be charged attorney fees or other expenses unless we are successful in obtaining compensation for you.
