Nothing matters more after an accident than your well being and healing.

Austin, Texas, Truck Accident Lawyer

The likelihood of a truck wreck is higher if the driver is tired and taking stimulants such as caffeine, alcohol or illegal drugs to stay awake. In one of the serious truck accident cases our lawyers handled, the driver was actually drinking beer in the cab under the belief that alcohol (a depressant) would help him remain alert enough to deliver his load.

Driver fatigue is a cause of truck accidents in Texas and other states. Trucking companies contribute to the problem by putting economic pressure on drivers to deliver loads faster and looking the other way when drivers fail to take the rest breaks required by the Department of Transportation.

At the law firm of Leonard B. Gabbay, P.C. in Austin, Texas, our lawyers represent the victims of truck accidents. If driver fatigue was a contributing factor in your truck accident, our lawyers will work to hold the driver and the trucking company accountable.

Driver logbooks

Under Department of Transportation (DOT) regulations, truck drivers are required to maintain logbooks to show that they took their legally required rest breaks. To get around this requirement, some drivers keep two logbooks: one which is accurate and another which has been falsified to turn over to investigators if they are involved in an accident.

Careful investigation of records such as diesel fuel receipts and truck GPS data can reveal when a truck driver has turned over a false logbook. For example, evidence that the truck's GPS system indicates that the truck was moving at 70 miles per hour at the time the driver claimed to be resting can be presented to a jury.

When truck drivers falsify logbooks and willfully violate hours of service laws, our lawyers will seek punitive damages for accident victims.
