Seeking Compensation for Clients Targeted for Improper Solicitation
In Texas, it is against the law for attorneys to contact accident victims, people who have been arrested, and other potential clients in person or by phone to solicit their business. It is also illegal for them to pay referral fees to anyone who has engaged in this type of solicitation.
As of September of 2011, people who have been improperly solicited by lawyers and their representatives have a right to sue for barratry, commonly known as ambulance chasing. Austin trial attorney Len Gabbay has the experience to diligently pursue these claims.
Understanding Texas' New Civil Action for Ambulance Chasing
Most lawyers in Texas are opposed to ambulance chasing and would never engage in this type of behavior to sign up a client. Unfortunately, some lawyers have persisted for many years in engaging in illegal and improper solicitation in the hope of not getting caught by the authorities.
The new law makes it possible for individuals who have been approached by ambulance chasing lawyers to pursue claims and receive money damages from these lawyers.
If you have signed a contract with an ambulance chasing attorney, you may be entitled to have the contract thrown out and fees refunded. You may also be entitled to a $10,000 penalty to be paid by the attorney who engaged in or profited from the ambulance chasing.
If you were contacted by a lawyer or anyone else — from a chiropractor to a tow truck operator to someone who claims to be from an official-sounding association or board — who you suspect was being paid by a lawyer to solicit your business, we will investigate your case to determine whether ambulance chasing occurred.
